Terms of Service
Last updated 30 October 2026
These terms are the agreement between you and TinyDesk Studio, a software product operated by an individual developer (a sole trader, not a company). They cover what the service does, what you pay, what you may and may not generate, and what happens when something goes wrong. By using the site, uploading photos or buying credits, you accept them. If you do not accept them, please do not use the service.
1. The service
TinyDesk Studio produces one specific output: a 15-second vertical video in which the people in five photos you supply appear as a band performing on a pre-built recording-studio set, over an original AI-composed soundtrack.
The staging, camera moves, edit and soundtrack are fixed by a template that we produce once and reuse. You choose the photos; you do not choose the scene. There is no prompt box, no timeline editor and no custom set.
Generating a preview is not charged and does not require an account. The finished video must be unlocked with credits before it can be played back in full or downloaded. We may add, change or retire features, provided we do not retroactively reduce credits you have already bought.
2. Eligibility and your account
- You must be at least 18 years old and legally able to enter into a contract. The service is not directed at children and may not be used by them.
- Sign-in is through Google. You agree to give accurate information and to keep your Google account secure; activity under your account is your responsibility.
- One account per person. Credits are personal, cannot be transferred, sold or shared, and have no cash value.
- We may refuse, suspend or close an account that breaches these terms or the Content Standards, or that we reasonably believe is being used to harm someone.
3. Photos you upload
You keep ownership of your photos. By uploading them you confirm and agree that:
- You own the photos or have permission from the rights holder to use them, and every person identifiable in them has agreed to appear in an AI-generated video.
- No photo shows anyone under 18, and no photo is used to suggest that a real person — a public figure, a colleague, an ex-partner — said or endorsed something they did not.
- You grant us a limited, non-exclusive licence to store, resize and transmit the photos to our AI model providers for the sole purpose of rendering your video. This licence ends when the files are deleted.
- We do not train models on your photos, do not publish them, do not resell them, and do not use them in marketing without your written permission.
- Uploaded photos and rendered files are deleted within 30 days, or sooner if you ask us to.
You are responsible for any claim arising from photos you did not have the right to upload. See section 12.
4. Credits, prices and payment
- The unit of billing is the credit, not the number of attempts. One finished video costs 50 credits.
- Current packs, in US dollars: $5.99 for 50 credits, $9.99 for 100 credits, $14.99 for 200 credits. The price shown at checkout is the price that applies.
- Every purchase is a one-time payment. There is no subscription, no recurring billing and no automatic renewal. We do not store your card.
- Credits are valid for 30 days from the date of purchase and expire afterwards. The expiry date is shown in your account and in the receipt.
- Payment is processed by a third-party merchant of record, whose own terms and privacy policy also apply to the transaction. We receive only your email address and the order status, never your card details.
- Prices exclude any taxes that the merchant of record is required to collect; those are shown separately at checkout.
- We may change prices for future purchases. A change never affects credits you have already bought.
5. Refunds, failed renders and rejected content
Because the product is delivered digitally and rendering begins immediately, you agree that performance starts when the render starts. That said, our refund rules are deliberately simple:
- Failed render: if a render cannot be completed, the 50 credits are returned to your balance automatically. No request needed.
- Rejected by content review: if we block a render because it breaches the Content Standards, the credits are returned to your balance.
- Nothing unlocked: if you have not unlocked any video, you may ask for a full refund within 14 days of purchase. We refund to the original payment method.
- Duplicate or unauthorised charge: contact us and we will refund it once verified, without requiring a chargeback.
- Expired credits are not refundable in cash, except where the law where you live says otherwise.
To request a refund, email [email protected] with the order ID from your receipt. We reply within 3 business days. If you file a chargeback instead, we may suspend the account while the dispute is open. Nothing in this section removes a statutory right you have as a consumer in your country of residence.
6. AI-generated output and intellectual property
- As between you and us, you own the video we render for you, to the extent the law allows.
- AI-generated material may not attract copyright in some jurisdictions — for example, the US Copyright Office has stated that purely AI-generated content is not registrable. We therefore make no promise that your video is exclusive or protectable, and we cannot guarantee that a similar output will not be produced for someone else using similar photos.
- We keep all rights in the site, the template, the set design, the soundtrack composition and the code. You may not reuse the template itself to build a competing service.
- The video is synthetic media. When you publish it, label it as AI-generated using the platform's own synthetic-media setting. Do not present it as real footage.
- We do not display your video publicly. Files stay available to you for 30 days and are then deleted.
7. Acceptable use
You may not use the service to create or attempt to create prohibited content, and you may not use it to break the law. The six prohibited categories — sexual and NSFW content, violence and gore, hate and harassment, child sexual abuse material and any sexualisation of minors, deepfakes and impersonation, and copyright or trademark infringement — are defined with examples in our Content Standards, which forms part of these terms.
You also may not:
- circumvent the payment step, the credit system or any rate limit, or automate submissions in bulk;
- resell, sublicense or white-label the service without a written agreement with us;
- reverse-engineer, scrape or copy the site, the template or the model prompts;
- upload malware, or content you have no right to use;
- misrepresent the output as genuine footage of a real event, or use it to harass, defraud or defame anyone.
8. Moderation, reporting and enforcement
Every uploaded photo is screened before rendering, and every generated preview is screened before it is shown to you. Flagged items are reviewed by a human. Depending on the finding we may reject the upload, block the render and return the credits, remove the output, warn you, suspend the account, terminate it, or report the matter to the relevant authority. Child sexual abuse material is always reported and the account is terminated permanently.
To report content or behaviour, email [email protected] with the job ID if you have it. Details of what happens after a report, and the timeframes we commit to, are in the Content Standards.
9. Availability and changes to the service
The service is provided on a best-effort basis. Renders depend on third-party model providers and can take several minutes or occasionally fail; we do not guarantee uptime or a delivery time. We may perform maintenance, and we may change or discontinue a feature. If we discontinue a paid feature while you hold unused credits that can no longer be spent, we refund the unused balance.
10. Disclaimers
The service is provided “as is” and “as available”. To the extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the output will be free of visual artefacts, that a likeness will be reproduced exactly, or that the output will be lawful to publish in every country. You are responsible for how you use what you generate.
11. Limitation of liability
To the extent permitted by law, our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim, and in any case to the price of the affected order. We are not liable for indirect or consequential loss, lost profits, lost reputation, or loss of data beyond our reasonable control. Nothing here excludes liability that cannot lawfully be excluded, such as fraud, or death or personal injury caused by negligence.
12. Indemnity
You agree to indemnify us against claims, damages and reasonable legal costs arising from photos you uploaded without the right to do so, from content you generated in breach of these terms, or from your use of the output in a way that harms a third party.
13. Suspension and termination
You may stop using the service at any time. We may suspend or terminate your access if you materially breach these terms or the Content Standards, if we are required to by law, or if your use threatens the service or another person. Where we terminate for breach, unused credits are forfeited. Where we terminate without cause, we refund unused credits. Sections that by their nature should survive termination — ownership, disclaimers, liability, indemnity — survive.
14. Governing law and disputes
These terms are governed by the laws of the People's Republic of China, and the courts of Guangzhou have jurisdiction, without affecting any mandatory consumer protection you have where you live. Before starting proceedings, please email us and give us 30 days to resolve the issue.
15. Changes to these terms
We may update these terms. The date at the top always reflects the current version, and for material changes we notify account holders by email at least 14 days before they take effect. Continuing to use the service after that date means you accept the new version.
